The Workmen’s Compensation Insurance provides protection to employees of Insured against any injury or disease arising during the course of employment. In accordance with the Workmen's Compensation Ordinance 1952, employers are legally obligated to insure their employees who are defined as "Workmen" under a Workmen's Compensation Insurance policy. However, this stipulation is no longer applicable to employees who are SOCSO members as provided under the Employees Social Security Act 1969.

Your workers will be paid the following benefits:

  • Compensation as laid down by the Workmen's Compensation (Amendment) Act 1996.
  • Legal liability at Common Law.
  • Death or injury benefits.
  • When common law coverage is affected, it will also indemnify you as an Employer if you are being sued by your employees for negligence.
  • Employees of sub-contractors may be covered by including the wages & declaring the name of the sub-contractor.

 

Your workers/employees who are covered are :-

  • Workmen as defined in the Workmen's Compensation Laws.
  • Workmen who are not workmen insured under the SOCSO Scheme.

 

Compensation under the Workmen's Compensation Law is payable regardless of negligence of the employer. In making a claim against you, the workmen has the option of either seeking relief or compensation under the Workmen's Compensation or under Common Law. On this matter they cannot claim compensation under both the Workmen's Compensation and Common Law.

 

Common Law liability is excluded from the standard Company's Workmen's Compensation policy. To reinstate this cover, the Company requires an additional premium to be charged and the limit provided in respect of this extension is limited to RM1,000,000.00 any one claim or series of claim arising out of one event and in the aggregate during any one period of insurance. Higher limits can be granted subject to the prior approval from Zurich.

 

Workmen's Compensation Insurance should cover :-

  • Workmen as defined in the Workmen's Compensation Laws.
  • Workmen who are not workmen insured under the SOCSO Scheme.
